Terms of Service – MindShift

1. Acceptance of Terms

By downloading, installing, or using MindShift ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

2. Description of Service

MindShift is a self-improvement and motivational AI coaching application. It provides tools for mood tracking, personal reflection, and AI-generated motivational guidance.

      ⚕️ IMPORTANT: MindShift is NOT a medical service, psychological therapy, psychiatric treatment, or substitute for professional mental health care. It does not diagnose, treat, or cure any mental health condition.
    

3. Eligibility

You must be at least 13 years old to use the App
Users aged 13–17 should have parental consent
By using the App, you confirm you meet these requirements

4. Subscriptions & Payments

Free Plan

Available to all users with limited AI interactions (1/day, 10/month).

Premium Plan – €9.99/month

Billed monthly through Google Play Billing or Apple In-App Purchases
Auto-renews unless cancelled at least 24 hours before renewal date
Cancel anytime through your app store subscription settings
No refunds for partial billing periods unless required by law

      Payment card details are handled entirely by Google Play / Apple. MindShift never stores your payment information.
    

5. User Responsibilities

You agree NOT to:

Use the App for any unlawful purpose
Attempt to reverse-engineer, hack, or abuse the AI system
Share your account with others
Submit false, misleading, or harmful content
Use the App as a substitute for emergency mental health services

6. AI-Generated Content Disclaimer

AI responses generated by MindShift are for motivational and educational purposes only. They:

Are NOT medical or psychological advice
May not always be accurate or appropriate for your situation
Should not replace professional consultation
Are generated by third-party AI (OpenAI GPT-4o-mini)

7. Intellectual Property

All content, design, code, and branding of MindShift is owned by the MindShift Team. You may not copy, reproduce, or distribute any part of the App without written permission.

You retain ownership of the personal content you create (journal entries, notes). By using the App, you grant us a limited license to process this content solely to provide the service.

8. Limitation of Liability

To the maximum extent permitted by law, MindShift is not liable for:

Any mental health outcomes resulting from use of the App
Decisions made based on AI coaching content
Indirect, incidental, or consequential damages
Service interruptions or data loss

      In no event shall our liability exceed the amount you paid in subscription fees in the last 3 months.
    

9. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time from Settings → Account → Delete Account or by emailing privacy@getmindshift.app.

10. Governing Law

These Terms are governed by the laws of the European Union and, where applicable, Greek law. Any disputes shall be resolved in the competent courts of Greece.
